Whereas the contents of FIR clearly indicates that the clips disc continuities out broken AV footage, post production editing whereas Vineeta in her statement deposed before the Magistrate under Section 164, Cr.P.C. categorically has not mentioned the involvement of the Minister and his PA and this statement has been erased. And since the petitioner himself has shown the inability to produce original CD, the copy of the same was obtained and sent to the FSL for examination and the offence made out under Sections 465, 469, 471 and 120-B, IPC. which is cognizable. Thus the police officer is empowered to investigate into matter under Section 156, Cr.P.C.
