Fake hra reciepts by wife despite own home

Hi,

My DV and divorce case are ongoing, got two kids 15 and 10 yr old. Wife also govt servent.

Today going through my old documents, I found my sweet wife has claimed HRA by submitting fake reciepts despite having own flat, registered in my and her name jointly.

Can you please help with the following queries..

- Should I report this to Income Tax Department or her department??

- Since she is goverment servent, can she be suspanded/terminated because of this??

- If she is suspended/terminated, will there be an impact on the maintenance decision for children and her?

there is nothing in IT act that says that you cannot claim HRA if you have a house in the same city, the only condition is there should be a rent payment evidence.

Except for income tax exemption, no other benefit the rent paid receipt will be utilised.  What will the department take action on?  mal practice? or misappropriation or embezzlement?, let she claim anything until she is not troubling you

file a case of perjury(crpc 340/195 and a case of 420.regards
