FIR

Dear Members,

 

I have a doubt that  a case was booked by police under crpc whereas in FIR under sections IPC is booked . Is FIR is registered under Crpc or IPC. Kindly enlighten me in this regard for which i am very grateful to all.

Cr.P.C. is a procedural law and IPC is a substantive law.  If any offence as described in IPC is occured, FIR is registered under Section 154 of Cr.P.C.  The procedure laid down in Cr.P.C. is followed to try the offences of not only IPC but also other criminal major and minor acts.  But, there are some offences like Section 107, 151 cr.p.c. are there.  Such offences are also tried under Cr.P.C.
