Fraud done by patpedhi

A patpedhi has done fraud with me. They issued loan on basis of my flat's fraud documents to someone else without verifying the documents and now they issued Japti notice. I was totally unaware about it. Came to know about whole chapter after the notice. Now I have asked for all the documents related to loan but they are delaying it. To whom shall I address in RTI to get the documents.

If you have received notice, you first issue a reply notice through your advocate and deny the allegations.

Simultaneously you may approch civil court wittyh an injunciton suit to restrain them from proceeding with the intended action which is found to be initiated on the basis of the fake fabricated documents.

I did not allow them to attach my flat, now to revoke the notice I will require documents related to the loan. They are delaying for that. What can I do to get the documents?

You were advised to approach court and seek for permanent injunction against them on the subject matter and an application for temporary injunction restraining them from interfering with your possession and enjoyment of the property besides to stall all further proceedings in this regard till the disposal of main suit.

You have to initiate a quick action immediately instead of wasting your time in such queries through various legal forums.

The facts posted are less than convincing. To my knowledge, a Pathpedhi cannot attach mortgaged property on its own; only a civil court can.
