Gift deed cancellation

Hello Sir,

Our father has filed a suit under section 23(2) of the THE MAINTENANCE AND WELFARE OF PARENTS AND SENIOR CITIZENS ACT, 2007

Prayer:
Cancelation of 1/2 share of property given by registered Gift Deed in 2009
and Monthly Maintenance of 10,000 each by two sons

History:

Our mother died and father remarried within a year
Father has two sons from first wife and 1 property
Second wife has 1 property and 1 daughter from first marriage who is married

Our property was joint property between our father and mother
Mother died, mothers half share with two sons (father share given to sons through relinquishment deed)
rest 50% share given to sons through registered gift deed without any conditions, irrevocable clause mentioned.

Now father under influence of second wife and daughter and son-in-law files a suit for cancellation of gift deed
and monthly maintenance of 10,000 each

Questions?
1. Can the gift deed be cancelled for 50%
2. Father has monthly income through FD's of about 9500/- plus we give maintenance of 5000
   Can court increase monthly maintenance?
3. what does section 23(2) of the THE MAINTENANCE AND WELFARE OF PARENTS AND SENIOR CITIZENS ACT, 2007 mean?

Has your father mentioned in the gift deed , that he is gifting his share of property in return for taking care of him in old age..?

No Sir, its mentioned in the gift deed that it is unconditional and irrevocable and that we are signing the gift deedas a token of acceptance. This gift deed is out of love and affection and under no influence..

Plus its been more than 3 years that gift deed was executed and registered...

the case is being filed on influence of our step mother as she wants share in the property for her daughter..

She already has 1 property that she has given to her daughter from 1st marriage.

In that case, your father cannot cancel the gift deed by filing under 23(2) - mwps2007. The court may allow for change in maintenance only if the material facts have changed since the time when it was initially decreed. Are you paying maintenance as a result of a court decree..?

no we are just paying him money due to father son relationship...earlier we were paying by cash but since last 3 months through cheque  as his behaviour has changed.

1. what does section 23(2) of the THE MAINTENANCE AND WELFARE OF PARENTS AND SENIOR CITIZENS ACT, 2007 mean?

2. can lawers represent us in this tribunal? because as per the maintenance act 17. Right to legal representation : Notwithstanding anything contained in any law, no party to a proceeding before a Tribunal or Appellate Tribunal shall be represented by a legal practitioner
