There must be a Gazzet Notification regarding the gratuity. You have to collect that. Go to a lawyer in your local (specialization in service matter). You must have taken offer letter, join letter, company detail, your salary slip etc. I think you have to approach to the Industrial Tribunal for this. Before all this you have to send the legal notice.
