Sir, I had worked as private company for 14 yrs, i had not get gratuity from the company. i ask many more times, but any body no response. so kindly help me. Give me legal procedure. mail.id : mohanaasiva@gmail.com

What is this establishment; Commercial,Industrial?

In which year you joined? How many persons were employed in it, at that time?

In which year you left? How many persons were employed in it, at that time?

What was the max. no. of employees at any time?

 

Did you communicate in writing?

Did company reply in writing?

Hi.. Shivanandan, Don't approach much to your previous employer because its your money no need to beg. Send one legal notice to your employer he will settle the dues within days. Calculations of gratuity : Last basic/26*15*No.of years served=gratuity amount

There must be a Gazzet Notification regarding the gratuity. You have to collect that. Go to a lawyer in your local (specialization in service matter). You must have taken offer letter, join letter, company detail, your salary slip etc. I think you have to approach to the Industrial Tribunal for this. Before all this you have to send the legal notice.

Employee does not have to approach Industrial Tribunal for payment of Gratuity.

 

Avoid jumping to litigation, starightaway.
