Husband's share on wife's ancester property

Hi All,

My mother's sister was declared as civil dead in court. she was married but left her husband long back 

she was not legally divorced. They have no child. Her husband got second marriage...

Now whether her husband having any rights on her ancester properties?

Whether he can file a case against us to get the property..

please help,

The husband of your mother's sister has no legal right over the ancestral property of his wife's paternal side. He cannot legally claim a share is such property.

Thanks Arachana for your quick reply,

my confusion is they are not legally divorced. They have just left one another with out any written statement about divorce..

is it means they still husband and wife?
