Since 2016 matter is stuck in High Court and whenever mentioned by advocate on record for early hearing Judge say no urgency. Petitioner is senior citizen. He is constrained to file 2 more cases and is worried about the delays. What happens if he dies during pendency due to viabrant judiciary?

His wife and children become legal heirs and it continues on bringing them as legal representative on record and suit continues till dispose  if it is civil ,if it is criminal then state has to continue until dispose.

Rule 1 of Order 22 of the Code declares that the death of a plaintiff or defendant shall not cause the suit to abate if the right to sue survives.
