IPC 406 120B 420

we are running a coop society under state coop act and department. Management of the society recover some loan amount from these past members through cheque already given by them to the society as per society rules and regulations but these past members filed a case for recovery suit against the management and send legal notices under ipc 406,120b,420 to their personal address with name of the members of management (elected ).Management is only for welfare of members they paid nothing for this is it right to send legal notices to management personnel address with name as they are doing their duty and the recovered amount is deposited in societies bank account not management personnel bank account now one member of management is wants to resign from their post

so I want to ask can he resign from their post and what about cases which is in his name and address in the court
kindly suggest

Yes, when one holdsany office of profit or non profit he will be liable forall such acts of such organisation.

Secondly, even though this person resigns the case will not be withdrawn against him as the casehas already been registered and his act of resignation is subsequent.
