Ipc section 337 - need help

Hi..

My Friend going on a two wheeler. Suddendly one drunken beggar lady fell on him from 3-4 feet divider and got minor injuries on head.

She got recovered and discharched from hospital. Medical report says that she is fine and had alcohol.

At the time of accident Police conistable caught him and took him to the police station and filed a case under IPC-337. 


My Friend went to Court, took a bail and came out. He has got a date for the next visit to the court.


What will be the maximum punishment to this incident.


Note: He has no Driving License and Vehicle Insurance.


We need to have a lawyer for this or This can be closed with a fine. Please advice. Waiting for your Reply.

@Querist,

 

If you got convicted under IPC 337, you can be awarded 6 months imprisonment AND/OR fine of Rs. 500.

 

You got the bail because it's a bailable offence.Therefore,here bail is the rule and denial of bail is an exception.

 

It's compoundable.Meaning that the accused can compromise with the injured person with the permission of the court.Out of court compromise is of no value.

 

You can also be fined under Moter Vehicle Act 1989.

Dear Srinu,

Now you have got the bail. Don't worry on the next date of hearing submit before judge that you want to settle the matter fix it in lok adalat or plea bargaining. you have to pay some compensation to beggar along with fine and matter would be settled / compounded. 

Aside above advice,

This is matter where you can be discharged or at later stage acquitted from the court as you said alchol content was there. Whether Dr. mentioned this fact in Medical of that lady then you can be discharged.

since you are driving unisured vehicle without a license you (as well as vehicle owner) are guilty under MV Actregardless the alchohal element.

 

The begger woman will extract a pound of flesh and agree for settlement. Then act as advised above.
