Is a Magistrate receiving the complaint of ill treatment of arrestee empowered to issue any other direction to police authorities regarding the incident of ill treatment?
SARATHI VP Mr. (ADVOCATE) 24 August 2009
Well, firstly, under sn.54 of Cr.P.C., the arrestee can have himself examined by a medical doctor to show any proof of such ill-treatment. The judge shall inform this right to the arrestee and record it in notes papers as directed by the SC in sheela Barse's case.
Secondly, the arrestee may ordered to give the complaint in writing, take cognisance on it as a seperate case and the judge can isssue summons to the police.
