Is lawyer needed for mutual concent divorce case

My sister and her husband want to divorce with mutual concent. They approached a lawyer who gave them the draft of mutual concent. But now the lawyer is not avaiable. They have all the documentation ready with them.Can my sister and her husband use these document and file mutual concent case in court without the lawyer?

nope,the presence of lawyer is necessary to give identification of both you and about your statements .hire some another lawyer.

As per Family Courts act, the parties who are intending to get decree of divorce by way of mutual consent, shall present petition before the Family Court personally. If they don't know about the legal proceedings, they can file Petition U/Sec.13 of Family Court Act and seek permission of the court, to be represented by a legal practitioner, but they cannot seek it as of right. If the Advocate who filed petition on behalf of your sister is not available she can inform the same to the Court, to appoint any other advocate from legal services authority.
