Is there any minimum crieria of working days to pay epf& esi

I want to know that is there any criteria of workingdays to be worked in order to pay ESI  & EPF to contract workmen  . If so kindly provide the provision under respective acts.

 

Please clarify sir.

PF and ESI calculation has nothing to do with working days. The deductions are to be made on the gross salary calculated. If you are paying salary for 31 days, then the PF is to be deducted from the basic amount that you have for this period. Same way you have to calculate and deduct the ESI. Working days only apply for salary calculation and your PF and ESI will automatically follow from the salary you have calculated.

Sir , 

Even if worker works for 1 day in a month ( eg: Joined on 31st Aug 2018) would PF & ESI be deducted from his salary and remitted to athourities .

Or handover the matter to your legal cell for proper legal opinion by a very able LOCAL counsel specializing in concerned filed of law e.g; Labor  matters as in your case, and well versed with LOCAL applicable rules, precedence, latest judgments etc …. and worth his/her salt, can advise you and even help you.

Avoid IT’s and entities loitering at various online portals to allure and fleece unsuspecting/innocent/hapless  querists many of which advertise with pictures of sick and old indivisuals and claim to be some Lawyer ( infact a Liar) and flaunt unknown firms as Law Firms ( Infact Liar’s firms) ….and are good for nothing Mufatkhora’s ( Freemongers) looking for bakra/shikar…
