Two Girls aged 9 Years & 11 Years arrested and confined u/s 380 IPC.
JJB in Punjab declined Bail because
i) Natural guardians have not appeared. Only Aunt (BHUA) has come who is not entitled to take the girls
ii) Permanent place of residence of BHUA is in Madhya Pradesh and she would not be able to produce the
childern for inquiry / trial.
Please suggest the plea that should be taken in appeal u/s 52 of JJ Act.
