This refers to a land grab. My father’s property was fraudulently transferred by 3 people. They created a bogus Non Traceability Certificate, impersonated my father to issue power in one of their names, showed a fictitious person as another son of my father to witness the registration and sold the property to the other 2 of them after the demise of my father. As if to complete the process, the buyers created a bogus patta in their names.
My bare injunction suit and their declaration suit are pending before the civil courts since 2001. In the criminal proceedings by the State based on my complaint to the Commissioner of Police, Chennai, prosecution did not mark many vital documents like death certificate of my father, his admitted signatures, statements of respective authorities that the Non Traceability Certificate used by them and manual patta shown by them are all bogus and thus allowed acquittal of all the accused on benefit of doubt. I have gone for an appeal in 2015. The way the cases are proceeding in various courts without seeing the records or myself being heard, suggests nexus between the prosecution, court staff and the defence counsels.
I am already 72 and have lost my hopes on our justice system. Therefore I looked for alternatives.
1. I gave a complaint to the District Registrar, citing Cir. No. 67 dated 03.11.2011 by The Inspector General of Registration, Chennai and he, after a thorough scrutiny, recorded the fraud and issued an order to cancel the Bogus Power and the Sale and make appropriate entries in EC. Thus the cloud in EC is removed.
2. e- Patta is in the name of my father only.
3. The area is safe and secured and is in my physical possession.
If I produce these evidences in the court now, whether the Registrar’s order is voidable by the court on the grounds “lis pendens” ?
If the court can not decree the suits within a reasonable time, what is the way out?
In principle the fraudsters have got endless opportunities to move the higher courts and drag on the case for lifetime. Is there a Forum where my case may be referred to for scrutiny and speeding up?
Will the land ever come to my use within my lifetime?
