Leaves under Shops and Establishment Act

Dear All,

Under Bombay Shops & Establishment Act "Is there a law which mandates that earned leave of an employee needs to be encashed and cannot be lapsed?

V. VASUDEVAN (LEGAL COUNSEL)     11 July 2011

Chapter VII of the Act deals with the provisions on Leave with Pay - every employee who has worked not less than 240 days during a year  shall be allowed leave, consecutive or otherwise, for a period of not less than 21 days - Provided that such leave may be accumulated upto a maximum period of 42 days. Please read Sections 35 to 37 for full details.
