in 138 matter the complainant has filed 4 condonation of delay which is of 3 days.....coz they didnt got a/d card of the notice sent and after taking out information on which date the notice was served to the accused they file the case but with 3 days delay...is there any judgement 2 show tat they cannot file the case or their case gets dismissed on this ground???

There is no such judgement .... and there is provision for condonation of delay in the N. I. Act itself ..... Whether to condone or not is purely the discretion of the Court depending upon the reasons cited for the delay ...

delay can be condoned under section 142(B) NI Act.
