Marriage expenses/dowry/streedhan

My 498a wife claiming that they spent nearly 20 lakhs of rupees at the tie of marriage. 

For marriage

  • 3-4 lakhs,
  • as dowry 7 lakhs cash ( they claim at the time of marriage)
  • gold 6 lakhs (they claim i have stolen)

These numbers are not affordable for them. and also they dont earn anyway near figures.

how to backfire this claim?

If you want to fight back

I think you should check the list of streedhan and ask for the bills.If  you get the jwellary bills,you need to get it verified whether tax has been paid agains the bill or not. Next you can do is you can file tax evation petition (TEP) in the income tax department and also check how much tax FIL have paid in the last three years.

Mainly  "INSIST ON THE BILLS"... Gud luck

If they have the bills, It doesnt prove that if they have handed it to me or not. 

And also what if they shown photos of wearing jwellery? 

FIL is not working and also MIL do small business.

Your thought process is correct. You have to seek an affidavit from the claimant that they had this much money at the first place. First they should prove in court that they had the resources to generate this much of Stridhan/Gifts etc. Once they show their resources then let them prove it in the court by way of photographs, witnesses, videos etc.

 

Claiming something is very easy, but proving it is another thing. Tomorrow they may claim that they gifted you Taj Mahal, but they would have to prove it themselves, ultimately!

Can it be in this sequence

1. They need to submit the affidavit & bill that they have given the articles

3. Get the bills VAT verified through sales tax dept

2. TEP (Tax evasion petition) can be filled to income tax dept.

After doing all these , Now the drama will start.If your the bills are fake ,that will be now contemp of court

If bills are original then step no 3 will work an he will be grilled by income tax dept

Worst case - if income tax also they paid (i mean if they can show that they had sufficient money to pay these article/expenses)- Then they will have to prove that they have given you these articles.

But from your querry i think that they will be trapped in step 1 & 2.

On basis of FIR Can I FIle TEP  or i need to ask for affidavit?

what if they deny to submit Affidavit
