Marrying my first cousing once removed

Page no : 2

Pradeep   22 April 2020

Respected P.Venu sir, all forms of marriage has been carried out in our custom.. including marriage between cousins, between uncle and niece, and i do have legal proofs for those registered marriages. So i wish to know if a marriage can be made legal between me (uncle) and her (first cousin once removed/niece)

P. Venu (Advocate)     23 April 2020

Yes, such marriage would be legal. Moreover, even under the provisions of Hindu Marraiage Act, the marriage within prohibited relations is void, not illegal, at the instance of the parties to the marriage and not otherwise.

11 Void marriages. —Any marriage solemnised after the commencement of this Act shall be null and void and may, on a petition presented by either party thereto against the other party, be so declared by a decree of nullity if it contravenes any one of the conditions specified in clauses
(i) , (iv) and (v) of section 5.
