My employer is not paying my incentive.

Sir/ Mam

I was working in a call centre which is situated at Noida,where my company has not paid my incentive. i left my job.what remedy is available? what is the procedure to knock the door of labour court.?

Initally you should send a legal notice and of still the money is not paid knock the door of labor court.

You may be having some evidence of incentive announced (circular), performance.......................being eligible.

 

Was it included in FnF statement/settlement and did you sign acceptance of FnF?

 

Incentive is fruit of labor.

 

You may approach BPO/IT/ITeS Employee's unions, Trade Unions, Labor alw consultant and your counsels may opine that this can be recovered by your own efforts/with thier support or you can approach:

 

Inpsector appointed under; UP Shops and Estabs Act, Payment of Wages Act

O/o Labor commissioner

Higher Officials of Dept of Labor

Civil Court

Fie compalint u/s406,420, winding up petition

 

and that you can agitate at your current location if company has an office there or your last location or location of Redg. Office of the company.

Thanks Kapil sir and kumar sir for replying on my post? Sir if he is not agree to pay my incentive then which case is suitable either money suit(recovery of debt.) or labor court.

I suggest check before that if this company paying incentive or Bonus in year and what is its term

if its monthy then only its included in the salary (Incentive)

If its yearly then it will get paid one time in a year

Please tell me under which act a lawyer can send legal notice on behalf of his client.if under cpc then tell me detail i mean under which order and which rule. if two client has same issue then a lawyer can send legal notice on behalf of both or it should be send separetly?

Don't bother about CPC etc. YOur lawyer would know.

A lawyer can send notice on behalf of as many clients.
