Name change in house agreement

Dear All Eminet Lawyers,

I just want to know the process and procedure about the name change or removal of one name from a house agreement.The case is the house is in the name of husband and wife. Recently the husband expired in an accident. The family has two children [ both adults] son and a daughter. Is there any necessary to intemate the govt. authority for deletation of hudband's name from the house agreement. Also is there any provision to mention the childrens name with equal proporation of share in the agreement.[ as nominees]

Hi,

No need to change th names in the house agreement. As the property is in the name of the husband and wife and the husband is expired as you said.. then in such case just make an application to the revenue department and corporation authority along with the copy of the death certificate of the deceased and an affidavit mentioning the name of the successors and specifically mentioning that there are no successors other than the mentioned ones.

And do mention in the application to add the names of the successors as the owners in the relevent records of the ownership of the property.
