Need for judicial reforms - jury, jpe system & s.219 ipc

 

Judicial Reform initiative

Writ Petition (Criminal) 40/2013 has been filed before the Hon'ble Supreme Court of India for introduction of following provisions:

 

1) Jury system with sectional representation of women, religious community, SCs/STs/OBCs, etc, so that biases against these sections in judicial proceedings could be reduced/ minimised, although elimination of such biases may not be possible due to human and social nature;

 

2) Judicial Performance Evaluation system against each judge, by the respective Bar Association members (on American Bar Association model of Feb' 2005) as well as by the superior judges at the stage of hearing Appeals on individual cases;

 

3) Transparency and proactive reasoned decisions in disposal of proposals on Sanctions u/s 197 CrPC, especially for the offences u/s 219 IPC in matters of passing corrupt or malicious order, verdict or decision in judicial proceedings;
