Dear All.

My wife filed a case for null and void against me but court declined the petition after hearing both of us.

Now my inlaws as asking for to sign a stamp paper. Regarding this paper she told that the paper will a memorandun for NOC for 2nd marriage. Is really this type of paper is there in marriage laws. If there what will the impact on our life in future.

Even though prima facie, it appears that NOC proposed by them does not serve any purpose, but for giving definite reply, it is required to know that on what grounds the court dismissed her null and void petition.

Thanks Mr. Chandu for your reply. She have filed u/s 12-1-c. Court dismiss the file by saying this is not a valid ground.

By giving the sign on the stamp paper what right i will give to my wife. In future what will be impact on MCD

The marriage subsists.

Noc has no legal validity.  On the basis of NOC if any spouse goes for another marriage, that marriage is itself illegal and also attracts bigamy provision.

file MCD.

get rid of the woman who does not want to live with you.

NOC (stamp / bond paper / notarized / registered at sub-registrar) is totally invalid & having zero value in the eyes of law.

NoC has no validity, if she is in a hurry to get remarried, go for MCD with ZERO alimony.

what is MCD with zero alimony?

MCD - mutual consent divorce.

zero alimony = wife agreed for divorce without asking for any money.
