not giving me the last month salary

Hi,


Please help me. My previous employer not clearing my dues(i.e. last month salary etc). When I have gone to office for the same they said we will not give you anything, however I spent notice period of 17 days and they have given me release letter but not clearing the dues. I worked there 10 months, this is an IT company at Noida. My last working day was 1st April. So, please help me to get the dues.

send the notice to  your previous company what you said reason.

You may go thru your appointment letter and check, what is the notice period in probation period and after confirmation of service, and accordingly what is the notice pay to be remitted.

And whether it is stated that after probation period is over services shall be confirmed in writing, and whether it is stated management reserves the right to accept the notice pay in lieu of notice period.

If the notice period applicable in your case was say 1 month and you have served for 17 days, then company can deduct pay for balance number of days from your F&F.

You have been given the relieving letter.

You may send a letter   under acknowledgment to your appointing authority/MD/Company Secretary, and mention that you have completed all the due formalities and hence company has supplied the relieving letter to you, but your account has not been cleared and your wages due to be paid by the company have not been paid to you, and  F&F, work experience certificate, Form 16,PF accumulation reports have not been supplied to you, despite your representation to Mr./Ms........on dated ........, and that the good office of appointing authority/MD/Company Secretary, is requested to supply the same to you within say 15 days by registered post.

Learned Mr. Sheik Mohammed has already given valuable advice on serving the notice on the company.
