Notice during probation

Hi Experts,

I works for HCL Technologies, Chennai Location and serving notice during probation. As per the policy, the notice is 90 days for both permanent and probationary employees. Does we have such policy of 90 days notice during probation?

My offer letter Says 90 days of notice in general and no clue of differenciating permanent and Probatonary employees.

If there si clause of 90 days notice then it is binding on you as you have given acceptance for it.

Offer letter says the notice is 90 days. But didn't mention about probation or permanent. As per the company policy, notice is 90 days for permanent employees and not giving any clarity on Probationary employees. I checked with the HR and she said Permanent includes the Probationary employees as well. My concern is that does we have any law to provide notice during probation? Does the company can ask for 3 months notice during probation?

What is this establishment; Commercial, Industrial?

What is its nature of business say; IT, ITeS?

How many persons are employed in it?

What is your designation and nature of duties?

How many persons report to you?

Do you have any power to sanction leave/increment/appoint/terminate/appraise etc etc ?

You are in which state? Since how many months you are working?

Do standing orders (model/certified) apply to establishment and your designation?

What is isued to you; offer letter or appointment letter or both? 

What is notice period as per appointment letter/offer letter and what was notice period tendered by you?

Yuo have been working for how many months?

 

Was ever any stinker, memo, show cause notice on any misconduct issued to you?

Are you a member of employee’s/trade unions?

Has the establishment issued/supplied, offer letter, appointment letter, salary slips of all months, PF number and a/c slips of all years, ESIC card,

While you separate ask to supply above and correct FnF statement, acknowledgment and acceptance of notice of resignation/final resignation, acknowledgment of handover of charge, NOC/NDC……………?

Relevance of seeking all this detailed information about the querist and his organisation by the expert merely with reference to the notice period is not understood?

Could you find any logic in asking such a very long information from you?
