Hi Lawyers,

My mother received a judgement order on march on 3-Mar-2010 from  Mumbai Suburban District Consumer Dispute Redressal forum, Bandra, but the shocking thing is that we didn't received any notice prior to this judgement and we were unaware that any complaint has been raised on my my mother by the complainant.

THis order were sent to my mother and to our society.

The secretary of the our society confirmed that he also not received any order before

this judgement.  So in this case I have writen a below reply to the president of Redressal forum. Please advice what should be done here, do I take here advocate help

or I can reply directly to the president. Pls guide me.

Respected Sir,

 

I am in receipt of your order letter on 3rd March 2010. I deny all the allegations made against me from the complainant M. P. Daswani. 

 

I would also like to inform you that before this order I didn’t receive any prior notice from “Mumbai Suburban District Consumer Dispute Redressal forum”.

 

I am surprised to see how the order is passed without giving any prior notice to me or any chance to prove myself innocent. I am also not aware that there is a complaint file against me by complainant M.P. Daswani, so I request you to keep this order aside at the moment.

 

I, being a senior and responsible citizen deny that there is any leakage in the flat

B-4/16 due to my act or omission from my side. The complainant’s allegations and the claim for the damages are untrue and imaginary.

 

I like to inform you that our building B-4, which is more than 40 years old, was plastered and repaired in 2005 by the private Civil contractor ‘Rasik and Elias civil contractor’. After our building B-4 got plastered/repaired, the complainant M.P. Daswani himself has carried out the extensive repair work in his flat B-4/16  by the same private contractor ‘Rasik and Elias civil contractor ’ which has caused damage to his own flat and to my balcony flooring (tiles) and other parts of my flat. So he should get repair my flooring.

We have never carried out any repair work in our flat.

 

I would also like to inform you that our tenant Mr. Deepak Gandhi, who was staying in Flat No. B-4/20 informed me that the complainant has sent the plumber of the same contractor and sealed our balcony drainage/pipe by cement without taking my approval. This was brought to the notice to BMC engineer who inspected the

Flat( see                                                                                              )

and also to Dy. Registrar of societies, ‘R’ ward along with the administrator of the Bachani Nagar CHS on 20-9-2007 who inspected his and my flat.

 

I would also like to add that when our building B-4 was plastered and repaired on 2005, each member of this building contributed Rs. 40,000 each, but the complainant M.P. Daswani didn’t paid a single paisa for the plastering work, on the contrary he use to obstruct the work.

 

The complainant is merely harassing me and other members of the society. So please ignore his complaint, and I request you to allow me to prove my innocence.

 

Please do the needful, I am waiting for your reply.

Mr. Chandrani, Please file appeal against the said exparte order of Suburban Forum in the State Commission, without  losing time, and mention the details in your appeal, which will be an effective step in settlement of your grievance.

CHANDRANI,       YOU   SHALL   FILE    AN  APPEAL   BEFORE  THE      STATE      CONSUMER    DISPUTE REDRESSAL       FORUM    AGAINST   THIS   EXPARTE   ORDER    WITH IN  30 DAYS.   SO   DON'T   WASTE   TIME     &   DO   AS   EARLY   AS   POSSIBLE.     FURTHER   ENGAGE    ONE   LAWYER    ON   U'R   BEHALF   TO  APPEAR   IN  THE  STATE   COMMISSION.

As suggested my by friends, you need to file an appeal immediately before the state commission, which is opposite CST Station (VT). You may file the appeal either through an advocate or an consumer activist (should be available in the State commission panel.
