Partial land encroached by a relative

Dear Forum Members,

                                          My mother aged 49 have property which was gave by my grand mother. In the FM plan it is mentioned that 108 feet for my mother both in north & south side.

                                          But for her sister it was given 93 feet in south & 153 feet in north. As per the mother document(partition deed) we both are supposed to have equal land mass. But as per FM they are getting more land. 

                                          Eventhough they are getting more land we didn't created any disputes. Now the problem is they are claiming they should have 100ft in south instead of 93ft in the FM. Just by putting the survey stone wrongly  form 93ft to 100ft they are claiming this is the original. 

                                          When we tried to place the survey stone as per the FM they are threatening us. Also we tried to build a compound wall in our land. During the constrution they interrupted and damaged all the materials.

                                           More than two times we surveyed our land with the help of VAO. VAO placed the survey stone as per the FM. Later sometime they will restore as per there wish. 

                                            Making a police complaint doesn't make any improvement. Police informed us while surveying both the parties should be there. But while surveying they are not coming to the spot. Later they are creating the problem. Don't know what to do. 

                                            Please give us the right suggestion. 

                                            I think in India justice is only for those who are having money, muscle and political power.

Please make a fence (even temporary will do) immediately after joint survey while the surveyors are present. And if possible get more witnesses during this. Immediately file a NC complaint with the police that your family members are trying to change the markings and encroaching on your part of the land. I would advise that you should try and talk to them to clear the matter but it is seen from your query that they are not listening to you. Hence these suggestions. S Jadhav

Hi Jadhav,

                    Thanks for your valuable reply. The problem is that they are not ready for the joint survey. They will also know that it is illegal. Eventhough they are doing the same.

                    How we can make possible it without the joint survey.
