ee retired on June 2018 is not getting pension till today .office is not responding .can a case be filed against responsible persons under attrocity act?

It  takes time to settle pension cases ;and there is no discrimination on the basis of cast /reservations.

Just follow the case and get the status from the concerned department.

File simple RTI application under Life or Liberty clause and seek information as follows.  The authorities must respond within 48 hours.  Also go for first appeal if they fail to respond, and after one week of making your application, go for second appeal to State information Commission.   This may cost you less than Rs.100/- towards Fee (Rs.10), Postage (Rs.22 x 3= 66) + Stationery of 8 pages.  Once facts are on record, it strengthens your case.  Also, file grievance in CM Secretariat immediately.

Information solicited:

1. Please provide certified copies of circulars/orders/notifications that state the time frame for settling Pension for a retired employee.

2. Please inform the date on which relevant papers were received from employee and objections if any raised and not responded by the employee with such certified copies

3. Please inform the process so far taken place from the date of receiving the papers, date wise mentioning the dept., and name of the responsible official that has to take a decision.

4. Please inform present status and likely time required for such settlement.

5. Please provide a certified copy of orders/notifications/circulars that state the laid down procedure for raising the grievance for protacted delay in settlement of pensions.
