Power of Supreme Court to transfer Civil suit.

 

Under section 25 of the Civil Procedure Code, power is conferred to the Supreme Court to transfer, at any stage, if satisfied that an Order under this section is expedient for the ends of Justice, direct that any suit, appeal or other proceeding be transferred from a High Court or other Civil Suit, appeal or other proceedings be transferred from a High Court or other Court in one State to a High Court or other Civil Court in any other State.

Question is under the Supreme Court Rules Part III Supreme Court possess Original Jurisdiction in Civil suit, so whether Supreme Court in exercise of its power under section 25 of the Civil Procedure Code, transferred any civil suit or appeal to its own Civil Original Jurisdiction for the ends of Justice.

The Apex court would concider only our prayer in the petition and would not out step from the prayer made under Section 25 for Transfer.
