497.     Adultery: - Whoever has s*xual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such s*xual intercourse not amounting to the offence of rap, is guilty of the offence of adultery, and shall be punished with imprisonment of either descripttion for a term which may extend to five years, or with fine, or with both. In such case the wife shall be punishable as an abettor.

THE INDIAN PENAL CODE, 1860

Law is sooo old 1860  and this is 2010.No Amendment in 497

 MARRIAGE IS NOT A PROPERTY, NOT A SUBJECT TO ENCROACH THE PERSONAL LIBERTY OF ONE'S.

 Neither wife/husband is a property of his spouse.If any body is not happy in his/her marriage she/he is free to take divorce showing the proper grounds which has made him/her to go to another man/woman.But without divorce keeping such affair shows the character of that spouse whether he/she deserves love or affection from his/her spouse or not.

IF ONE IS UNABLE TO MANAGE HIS / HER MARRIAGE, BY LOVE & AFFECTION, HE SHOULD GO OUT FROM IT.

THERE SHOULD BE A JPC TO ENQUARE, HOW & WHY A MARRIED MAN fails TO get love  & affection from his wife who still wants her husband back after knowing all about his ILLICIT relation with his K*** and surrender himself before another lady blaming his wife.
