I need some suggestion's regarding case (Private Complaint U\S IPC 420 , Section 3(1) SC ST Act) registered on us by the person who acted as agent(Who belongs to SC ST community died and his wife was a Non SC ST , She issued the notice from court) when we are purchasing a property in first half of 2007. This agent looked after everything from the time sale agreement to land registration. But due to some veyr urgent medical emergencies we decided to sell the property as soon as possible to get the money. We informed this to the same agent who help us at the time of land registration.Since he was an land broker he agreed orally (No agreements happened). Even after continous requests to him about sale he wasn't responded and we decide to sell the property on our own and and made agreement in Dec 2007.
Agent came to know about this sale agreement and threatened us with dire consequences if we havent cancelled that agreement.We didn't bothered about his threats and went ahead and sold the Land which was registered on our name. He filed a private complaint in the court U\S IPC 420 , Section 3(1) SC ST Act (He mentioned in the complaint that we abused him with his caste name and threatened him for his life) and police came Dy.S.P office and made an enquiry and we went to Dy.S.P office 3 times and answered to all the questions(Police didn't arrested us anytime). After investigation Police came to an conclusion that this case was false case and assured us this wont cause any problem to us.
Mean while in 2012 september we received a summons in registered post from court mentioning that Agent wife filed a complaint aginst us U\S IPC 420 , Section 3(1) SC ST Act and court asked us\ our lawyer to come and answer.
Need your advise
- If Investigating agency closed the issue mentioning the complaint as false do still court ask us to come and appear to answer ?
- How can we get the copy of F.I.R regarding the case to know what exactly investigation agency mentioned ?
- Do we have any problems(Like arrests) regarding this case again. We are well settled and respectable family in the society. My family are really worried and embarassed about this cases.
