In society during property conveyance from builder  , stamp duty is payable on Land & building. Land of society is open spaces which( land ) is used by flat owners commonly & equally where as flat owners  of building use their building area unevenly as per their area of flats . There fore it is logical that , the part of stamp duty which is of land of society shall be equally paid by all members  , but stamp duty of building shall be divided as per ratio of area of flats .

What is the legality in respect of stamp duty payments of individual flat owners against conveyance of society property from builder to society.

Prakash,

Theoritically you are right

but it is not calculated as in the fashion you claim

builders actually take it up as a SBA (Super built up area) for calculating the total cost of the flat + car parking additional
