Property share for brother not on registry document

Hi,

I've bought a property with my elder brother (AS) in 1983. The property papers are in my name and his name. There are 3 floors built in the property.

1. Ground floor where AS lives.

2. First floor another brother (BS), he has water, electricity meters in his name but property is not his name

3. Second floor is I live.

The property is located in Delhi. I've the following questions:

1. The property is not freehold, and my brother BS got some DDA paper signed from myself and AS around early 90's.There was no update to the registry documents and they are still in my and AS names. Does this gives him right in the property? If the property is sold is he eligible for a share legally?

2. As myself and my brother AS are two owners on the registry, Can I send a notice to BS to vacate my share of the property?

 

Depending on replies, I will like to seek legal assistance.
