Regarding 498a,dv act

Sir,my wife had filed against me & my family under 498a,DV act.

First she had made complaint in our local police station,then filed 498a.

With same FIR she had applied under DV act.

For both the matter she used FIR.

I want to ask you that 498a and DV act both will be carry on or not?

I heard from someone that if matter will be same in both the case only one will be procedeed..

Please suggest me...

DV and 498 A are independent proceedings . in DV wife can ask for right to maintenance , reight to residence , custody rights , compensation . , protection order .

 

498 A has been filed by wife for acts of cruelty by husband and  his relatives to meet unreasonable demands

BOTH THE CASE ARE TOGETHER MAINTAINABLE.
