Rent control - appeal against eviction

In a Rent control case, eviction of tenant ordered. There was no appeal against the eviction order. When EP was filed after some time, now appeal is filed after a delay of more than a year, on the plea that talks were going on with landlord. What is the limitation for appeal against eviction order and whether delay can be condoned u/s 5 of limitation act,?

"Talks were going on with landlord" is no ground to condone the delay of one year.For condonation of delay,each day of delay with sufficient cause has to be explained.
