City - Hyd. Recently I took an apartment for rent in Hyderabad. myself and the owner executed a lease in Rs10 stamp paper. It is 11 months now that i am in apartment and i want to move, but the owner is insisting that i should complete entire 24 months in the apartment. Here is the exact clause in the document"
"That the lessee wishes to vacate the property after 24 months shall give one month advance notice to the lesser in writing or mail and similarly in the case of lesser also such notice of one month shall be given to the lessee for vacating and delivery of the possession of the property"
I have paid all rents on time before 3rd of every month and have cleared all my dues to the society. I have also given one month intent to vacate notice via Registered post and have the receipt. I have paid the rent for the last month also. There is no clause in the document other than the above for vactating the premises from either side. There is no penalty clause mentioned also if tenant vacates before 24 months. My questions are;
a) Is it legal for the owner to compul the tenant to stay for 24 months.
b) Will i be eligible to get back my 2 months of rent in deposit?
c) Can the owner initiate a legal action against myself for vacating before 24 months?
d) How to get my money back? I dont want to give the keys to the apartment to the owner without he returning my deposit money as i have clearly given enough notice and cleared all my dues. Please advise.
