I've a question about my employment. I recently joined an IT company as Asst Manager, but due to some reasons I had to resign from the co within 28 days of my appointment and which has been orally accepted. Now the HR Manager is asking me to pay 2 months salary since I did not serve the notice period of 2 months during my probation period as mentioned in the apointment letter otherwise they will file a legal case and blacklist my name in Nasscom and will not even pay for my working days.
The caluses in my appointment letter say
a) In case the company finds your progress is not satisfactory or otherwise, your services will be terminated without any notice or payment in lieu thereof during the period of probation. If you desire to leave the company at nay future time, you will be able to do so only after completion of probation period, subject to adherence of notice period given elsewhere in this letter.
b) This contract of service can be terminated by either party by giving two months notice or salary in lieu thereof subject however, of the intention of the companyto relieve you of your duties currently being performed.
Now I want to know whether
1) Notice period will be effective even during the probation period ?
2) Do I really have to pay them 2 months salary which I cannot pay. If not, then will there be any legal consequences ?
3) Can the company blacklist my name with Nasscom with their influances ?
4) What will be my chances of confronting them incase they file a legal case against me ?
