The case is about an agriculture land and its inheritance.
The facts of the case are as follows.
(Names have been changed for anonimity.)
Mrs. Taruna Bai, had an agriculture land in her name and she has three daughters, Mrs. Shashikala Bai, Mrs. Parvati Bai and Mrs. Manjula Bai.
Mrs. Taruna Bai expired leaving behind these three daughters. After her expiry, at some point of time, the land got transferred into the name of Mrs. Parvati Bai, due to some act of commission or commission or oversight. However, it was and is expressly understood that the land was to be inherited by all the three daughters in equal proportions
Now, this Mrs. Parvati Bai has expired , leaving behind three heirs by way of one daughter, one son and one deceased son who has left his widow behind.
We now want to regularise the ownership of the land by introducing the names of the remaining two daughters, namely Mrs. Shashikala Bai & Mrs. Manjula Bai.
So, the ownership of the land will now rest with the three legal heirs of Mrs. Parvati Bai and Mrs. Shashikala Bai & Mrs. Manjula Bai.
How do we now correct the above situation and restore the ownership ? Both the sisters are not interested in partitioning the land and are only interested in adding their names to establish their status. The land can be sold jointly by all of them together and the monies received can be distributed amongst them proportionately.
Can it be done by making an MOU and registering it or how else can it be done ?
