Rules regarding payment of services tax

My builder is asking for payment of service tax of Rs.32,500. The society formation is not yet complete and Building Completion Certificates has not yet been issued. I am not clear as to why this service tax is being asked? Can you please clarify.

there is levy of service tax on construction of residential flats @ 3.09% on BSP and Stamp duty parts charges and 12.36% on PLC and other charges on which stamp duty is not  paid on before getting completion certificate .
