Sale deed draft

I am buying a resale flat. I have not made any payment yet for the flat as the owner is insisting on making a sale deed directly. I would like to know who is suppose to prepare the draft for sale deed and what clauses have to be mentioned to be safe in the future?

It depends on you as from whom you want to get the sale deed drafted. In sale deed the title should be clear, demarcated, defined and the chain of property should be authentic, there should not be encumbrance and there should be declaration etc.

'Buyer Beware' applies to property deals.

It shall be appropriate to get proper legal opinion from a very able local senior counsel of unshakable repute and integrity specializing in revenue/property/civil matters before signing or making payment.

This may cost some FEE but can defend long term interest and hard earned monies.
