anybody can give me a citation on sec5 of limitation act in order9 rule 13 of cpc, when limitation computed from the of knowledge on summons not served case, but petitioner was well aware about the case, as his father contested the matter and demised then petitioner came on record and set exparte. at the same time other defendants are also from same family and they are reesiding in same house, other defendants contested the along with petitioners father, now pet. taking the ground as not aware about the case, he came to know about the when he received notices in e.p. i want a case law to disprove his ground.
