selection in govt jobs:merit Vs entrance exam (Art 16 ?)

 

Respected Sir/Madam

If govt. tries to compare the candidates(open for govt. jobs) on non-comparable ground then is it against the article 16 of indian constitution that guarantee equal opportunity in all govt. jobs?

the whole matter is as follows

UP government has started entrance process for basic teacher training(BTC) for 17800 seats from 16 may 2010(source Amar Ujala News Paper Dated-16 May 2010).candidates will be selected on the basis of merit( marks obtained in 10th,12th and in graduation).one candidates can apply for one district only.for detail please see amar ujala news paper dated 16 may 2010. last date for submitting form is 8th june.

Besides it the UP govt has taken decision to select the PGT/TGT teacher on the basis of merit.(academic score)

But i and a lot of people like me have following objections.

1.Different boards/universities candidate will apply for BTC. how can we compare different board/university students on the basis of their marks. each board or university has different syllabus,different marking pattern.this can be easily proved by seeing past results,boards guideline for evaluation and by seeing syllabus of the same class. for example- a up board student of class twelve has combined syllabus for eleventh and twelfth class and has to prepare both year syllabus for 12th board exam while CBSE student has different syllabus for 11th and 12th.

2. my second objection is students of different streams of the same board/university or different board/university and of same stream but with different subjects can not be compared. some subjects are more scoring than others.this can be easily seen by checking past record. for example students who have home science, music etc subjects will get higher marks than a economics' s student marks. some subjects have practical components and the students who have practical subjects easily get higher marks in practical component. 

3.professional courses can not be compared with academic courses.professional courses has two types of evaluation. first internal and second- university based exam evaluation. in internal marking system most of the students easily get 80 to 100% marks. so a BCA ,BBA student can not be compared with a B.A. student whose evaluation is done only on the basis of university exam.

4-the student of same board or different board/university passing in different years can not be compared.education sector is changing at very fast pace. every year something new has been added and the facilities ,teacher method , evaluation method, syllabus and the government also are changing.so we can see the result of these changes on the marks of the students.

_ In up board when i passed the high school in 1999 , the Kalyan Singh led BJP government was there.CM kalyan Singh introduced nakal adyadesh(ordinance) .if any body found copying would had to go to jail. that year highschool result was only 29%.
_ Up to1999 there was a combined syllabus for 9th and 10th and 10th student had to prepare for both year syllabus for 10th exam.the marking pattern has also changed. in earlier time in maths and science no marks were given if the answer is wrong but now step marking is done and marks is given for right steps without considering answer is wrong or right. 
_now in UP nakal mafia is on high. there are several instances of paper leaks, group copying etc.(read editorial in amar ujala dated 16    may 2010)
_besides these there are varying infrastructure in villages, small cities and big cities that affect the mark securing ability of the students in their early stage of education.but they are in no ways less intelligent for the other students who are securing more marks. 

5.there is a provision of 50% parallel reservation for women.the net effect is that there is only 25% seats are available unreserved.it is  opposed to various courts decision in which court stated that total reservation should not exceed 50% upper cap.i am not opposed to the women reservation but excess of everything is bad because it will create social imbalance in society and we all of us has to face the bad effects of it.

please place your views in detail.i want to file a PIL against UP govt. order because govt. is trying to compare the candidates on non-comparable ground that is against the article 16 of indian constitution that guarantee equal opportunity in all govt. jobs.The govt. rightly has the power to set the criteria but that should be reasonable.The elected govt. should work according to declared policy not arbitrarily.the govt should set the policy when she will conduct entrance exam or when she will make selection according to merit based on academic score.
 
i sent similar letter to NCTE(national council for teachers education) and ncte's reply is as follows
"This is in response to your e-mail dt. 17.05.2010 in connection with

entrance test going to be conducted by Govt. of Uttar Pradesh for
admission to BTC Course. You have serious objections about the criteria
being adopted by Govt. of UP, though this matter pertains to State
Government however, as per NCTE Regulation 2009 the admission shall be
made on merit on the basis of marks obtained in qualifying examination and
/ or any other selection process as per the policy of State Govt. / UT
Admn. In view of this stipulation, the State Govt. of UP  has adopted any
of such pattern NCTE treats it compliance of NCTE Regulation 2009.

Immediately send a detailed letter by Rigistered A/D post  addressing to the Secretary of Education Ministry and mark a copy of the same to Chief Secretary of the State for information and necessary action.

 

Further we will follow...

I am obliged to you for  considering about the matter.As par your saying i sent the letter on 28 of may 2010by registered AD to the principal secretary of education department ,UP and chief secretary of UP at sachivalya , lucknow,UP. 

Please guide me for further course of action.

Thanking You for your able practical guidance & encouragement .I am trying hard as much as i can.Today i sent a mail to honorable HRD minister Kapil Sibal .Before it I send similar mail as i posted here to hundreds of NGOs .Very few of them replied and accepted that  my objections are right but because they are working in different field so they are not able to help me.

Can i directly send a letter to chief justice of high court Allahabad/Lucknow because i think my fundamental  right provided by article 16 of indian constitution  is being snatched.will they entertain my letter as a petition?

Curious to learn under your able guidance!

I sent the detailed letter to Principal Secretary  of Education Department and Chief Secretary of Uttar Pradesh.As par my perception about government officials, they did not communicate in any way .nor i think they will do.

Entrance process will complete in a few days(the last date of submitting application form is 8 june 2010) so  what can i do further to represent my case?Nothing!

You said in ur last post that

how can you say that we have an equal opportunity!if i can not present my case because of i can not hire a lawyer.i can not pay the court fee then what is mean to say that i have equal opportunity. opportunity is available only for haves.Most of the population of our country cannot present the case because of the systematic obstructions.

why am i not getting an opportunity to speak freely about my objections before the court.

i can prove that my objections are rights but at least should get the opportunity.I sent letter to Allahabad High Court Judges by e-mail(get from Allahabad high court Website)but all is in vain.NO body replied.at least they should reject my plea.

You think that we can defeat the corrupt persons on higher level in administration in a week's time... 

 

And it is the problem that if we extend our hand so restless people catch our neck thats why no one extend their helping hand to others..  As you are becoming restless for your own interest how many times you were become such restless for the matters of others !!

 

Your attitude descouraged us and we are now not going to come across you... SORRY.

I am so nice of you for giving your valuable time to my problem(if you read it carefully then you will find, it's not going to affect only me). As you have read in the post , i need the solution in a given time (because the last date for submitting application form is 8th june 2010 and whole process will complete in few days.then there will be no mean to say that you will follow.)

Definitely you do not have any interest in helping me but whole india will suffer in long run directly or indirectly as in the case of naxalite if such type of dissatisfaction  increase.

Alone from my problem i can predict what will be it's harmful effects

1.wrong and ineligible person will be selected and who will defeat the purpose of right to education act.

2.they will produce a young generation who will feel cheated by their teacher as well as by the system.

3.People like me will go for other mean(of all types ) to earn his bread and butter that may be against the morality because the most important moral principle in my view is my natural right to earn my livelihood and then all types of written books (constitution) principles comes.

when people like me will go for the revolt it will not be easy for the govt. to tackle the problem.we are being discriminated by the system right from beginning.firstly by double standard education system and now in employment also in the name of caste , s*x and most importantly on the name of language unofficially.firstly we are told that hindi is our national language and what do we see further that because we do not know good english or cannot speak english so we are not intelligent then why there is hindi or any other  local language medium for study.only for keeping most of us away from the big position in private or public post.if any one person get selected at higher post from hindi medium then it is propogated as there is no discrimination on the basis of language but result speak itself.see the result and you will get the right pattern. 

it is up to you sir ,you will help me or not .i am pure nastik(atheist)and i believe in some basic principles

darwin's theory survival of the fittest .natural rights come first and then all written principles and where there is a will there is a way.so if i am capable in the given situation i will find the right place.

i also want to answer of the question" how many times you were become such restless for the matters of others !!"

 i always discuss about the problems of our society  but because i donot have any monetary resource i can do very little .I am only 25 year old and struggling for my career.you can not compare me from other social worker but i am helping younger  by giving right information at right time that was not available to me when i was in need .

in the last i am really sorry to you if any of my words hurts you but sir see the things from my side, everyday i have to answer to the people whom i meet. what are you doing ?why don't you do something?whose son is earning why cannot you? you cannot succeed in life etc  .

I am so grateful to you that you gave your valuable time to me.

alongwith this petition, must demand a stay order on the proceedings going on.

Hi puneet saxena,

you are saying right, today I have seen the result of btc for year 2010 and found that u.p. goverment put,  up board, cbsc board and professional coures students one stream then prepared the merit list.  Let me know  how u.p. board studeant can fight with cbsc, or professional course students. This is absolutly worng decesion of u.p. government . .

kapil sibbal ji is doing good job but he is doing more room study than ground level study . he is going to introduce a change in the entrance process of IITs and going to provide 70% weitage to 12th class marks in entrance process and he said that he will find a formula to make all the boards marks equal but my objection is ,how will he make it sure that students getting fare marks because in uttar pradesh whole education system has rotten and paper leak, contract copying and poor invigilation during exam(because teachers think why should they take the risk) can be very easily seen .

in higher education there 587 engineering and management colleges who are selling degrees and looting the students with open consent of government and regulatory body(AICTE) .they are keeping teachers at 8000 and get signed from them at 18000.there is no supply and demand analysis about these courses and about the quality of education and after doing mba from these types govt. recognised institute they are getting a sales person jobs that they can get after doing high school. same is with B.Tech and other professional courses. so what the kapil sibbal is doing.we know what the govt. is doing with us and soon all of our society will feel the heat in years to come when there  will be more so called professional degree holder than academic courses with no employment at all
