Speed post tracking as proof of delivery

Can speed post tracking can be considered as proof of delivery or registered post with ad is valid proof?

Speed post tracking report is exceptional and in several cases considered as proof of delivery by the Hon'ble Court.

No. It cannot be. Speed post delivery report can be considered as proof of delivery of article to the address. Any one at the address can receive the article. So it doesn't indicate it has been delivered to the specific addressee. But in case of registered post, the article can only be delivered to the addressee alone.

1. Postal Speed Post Receipt and Tracking Report (downloaded from govt. postal website) .OR.  Acknowledgement Card, received & signed by ANYBODY at the designated address, is SUFFICIENT enough as irrefutable & conclusive Evidence, under the provisions of section 27 of the General Clauses Act.  The Post Master or Delivery man can be summoned as witness to testify, conclusively, without any further reference..

Even letters by Registered Post With Acknowledgement Due needn't necessarily be received by the addresse.

If that is the practice in vogue, then most of the courts are ill-informed of the distinction between speed post and registered post, which appear to be similar but quite different in substantive nature, by advocates who do not normally take much care in finding the distinct nature of procedural practices of delivery of both, well stipulated in the chrystal clear postal rules. If a court or advocate considers that delivery of both speed post and registered post are not different, it means that they have not got any chance to acquaint with the difference of both.
