my wife gor a decree of RCR(Conjugal rights) in the year 2012 , it was an exparte decree , recently I have filed an a fresh divorce application under hindu marriage act undersection 13 1a(2), the case got numbered 194/2016 initially the district court given the date on april 20th 2016 , but we filed an advancement petition and posted it to 18th match 2016 , since she did not executed the conjugal rights decree for the alomost 4 years , it a valid ground to get the divorce more over she left to abroad , in this instant case what I need to to get the early relief , even we got the court permission to send the summons through email and what ever the way we want .
my concern here is only one thing to file the counter the opponenet party may drag the time like anything what is the remedyto force them to file the counter , if they unbale to file the counter it will be an exparte decree obviously .
