STOP PAYMENT

I received cheque from one person for legal liablity discharge based on his insturction I deposited for payment and it got bounced due to 'stop payment ; on 15-01-2011, i didnt send notice, some one has told me that it can be presented at any time within 6 months. I re-deposited it again for payment but again it got bounced due to 'stop payment', now can I can send notice for scound one.


I heard that recent Supreme Court Judgement has held that secoudn time 'Stop payment' is not attrat for NI Act.

 

Please kindly provide me that Judgment atleast send me the link or Cititation.

Dear Future Lawyer,

You can present the cheque upteen times within the stipulated period of six months.  But the thing which you have to be careful is that you should strictly adhere to the limitation period as prescribed under N I Act.  Once the proceeding by way of Notice have started let the same get culminated in filing of complaint for the practical reasons. I hope this clarifies your query.
