Succession certificate

Dear Friends

I am about to file a Succession certificate application before the court at TIS Hazari, Delhi for the sum amount 3Lack deposited in the bank. The person is dies and left no will and the peson who has died was bachelor and left no son or wife. Now only one brother and sister is left. Now the bank is not releasing the money as they require to have succession certificate. Now I have the presecribed format so i want to know what are the others things are mandatory except the pass book, details of the bank and deceased person. and also what I have to mention in the Respondent. DO i have to write state of Delhi(NCT) or something else

Death certificate of the person s also necessary.  And you have to show how come you are relative of the deceased and only the surviving nearest legal heir of the deceased.

Ok thank you but what should be mentioned in the Applicant V/s Respondent. In the Applicant name of the both surviving brother and Sister will come versus.....

Is it not necessary to also put an advertisement in new paper before claiming ?

Respondent is the State and also the Bank, where the amount is deposited.  If possible, provide some document to show the relationship of the petitioners with the deceased.  Once case will be taken up, citation order (paper publication) will be given and after that taking the petitioner's evidence on affidavit, necessary certificate will be issued.

Dear Adv Chandu Thanks for comment so u mean the respondent 1 will be bank and Respo 2 will be state. Now a brief synopsis along with the date pf occurance has to filled with affidavit of both brother and sister stating that they are deceased brother and sister. Thanks for replying in adv

Hmmmmmmmmmmm, ours is very simple.we just go to the judicial branch of Deputy Commissioner or Additional Deputy Commissioner and obtain a form at the cost of Rs.5/- and  after 1 month notice is issued for any objections, it is isued. Ours is much simple and effective

I am also looking for advice for obtaining succession certificate.My grandfather left with some share of companies which is asking for succession certificate to divide the share between 5 legal heirs of my grandfather .Please advise how and whom to approch in Delhi pefer location Noida,Ghazjabad and east delhi.
