hi,

Can anyone please guide me,whether domestic violence (DV) is crimal  or civil charge??coz a reputed policeman told me that he wasn't able to stop my husband to move out of this country(India),just bcoz he was having a DV case on him & not 498A..so he & his police department helped my husband to make his duplicate passport. by clearing his verification....& insisted me  that Y I hvnt filed 498A instead of DV??

Who is right??my lawyer or a policeman?? or a police department is just shedding their duties by giving me false advices?

please suggest..

What is the suggestion of your lawyer? you have not stated clearly

However the police may be right in their version

@ Sister-----> i am also in same pain as you are my miserable husband fled away U.S. when i filed such cases.......i also approach ministry of external affairs as well as U.S. embassy but all my efforts were in vain......it seems police department is giving you wrong information perhaps they are not interested to help you out. If they wanted to help you out they could have definately stopped him flying out of country when you filed DV cases against him. It is very hard to extradite someone especially when they are abroad.I also tried doing such things for 3 years but no results matter of fact i was not even able to serve my husband summons...........here u are already suffering since u can't even get hold of his financial details............my advice to you is approach him nicely and resolve this issue atleast u won't loose all those precious years........better get married with someone else.

Which country has he fled to?

 

One good thing is that he's not a citizen of whichever country he's fled too,as his escape is recent.

@ Roshni kindly suggest as if there is any way we can extradite our husband. Here Author of this post has the same problem. I also want my husband to come to india and attend court proceedings but i can't get any track of him. At this point what should we do ? Should we approach him gently and resolve this issue among our families or is there any remedy under which our husband can come to india in order to attend court proceedings ?
