can any body can give legal openion on following case.
a suumary of evidence recorded on eight tentative charge in Army.
all 13 prsecution witness statement and 4 defence witness statement recoreded.
in five charges only witness alledgly allege accused. No other eye witness or any of witness has corroborated these five witness allegation.(charges)
but army frames all eight charges aginst accuced.
can accused can go to armed forces tribunal and get it dropped/ quashed above for these five charges. as no eye witness in S OF E and nor no one (other witness) corroborated allege charges
please give legal quote on this of supreme court or high court if any body have to help me.
