Summons served after date

1) Hearing fixed on date A.

summons served after date A ,say date B.

Meanwhile on A date , the other party got issued fresh summons without waiting.. hearing posted to date C.

so now whether summons are deemed to be served( ie summons served after date are valid)  and the person should attend?

 

 2)  What does contested -allowed means in a case filed under sec 13B?

allowed means mutual divorce- both parties are agreeing but contested means only one party is agreeing to proceed with divorce and the other is not agreeing

Why wait for summons, why not appear on your own?

 

Delay is going to hurt both the parties.

as you have already got summons niether future date or any another date you have to appear so appear and request if you want to contest the case that you want to take appoint a lawyer and request for further date and also mention that last date due to non receivable of summons you could not attend 

and if you do want to contest then appear through your lawyer as give consent for the divorce that you to want the same
