Tenancy agreement or rent receipt : which is powerfull?

my client has a tenant without tenancy agreement. he only has rent receipt to show that he has a tenant. now he wants to evict the tenant. would rent receipt be accepted inspite of absense of tenancy agreement ?

 

pls advice.

In the absence of a rent agreement he is considered as a tenant who is occupying the premises on a daily basis.so no need for notice you can ask him to vacate the premises straightaway.if he is not vacating then you can file a eviction suit

but how to prove that he is residing in my premises on daily basis ? i mean, court will not listen to my words only.

It amounts to monthly tenancy n can be evicted if ground available under rent act
